1.1. This document is a public offer by Andrei Vitalievich Shutov (hereinafter — the Provider) and contains all essential terms for the provision of automated digital image processing services.
1.2. In accordance with Articles 405 and 407 of the Civil Code of the Republic of Belarus (CC RB), the Customer's performance of any of the following actions constitutes full and unconditional acceptance of this offer:
— registration on the website fotolab.by and/or use of the website services;
— launching the Telegram bot @fotolabbybot (pressing the "/start" button);
— payment for the Provider's services.
1.3. The contract is deemed concluded in simple written form (Article 404 CC RB) and does not require physical signing by the parties.
2.1. The Provider undertakes to provide the Customer with services for automated AI processing of digital images using the Provider's software, and the Customer undertakes to pay for these services according to current rates.
2.2. List of services:
— automatic light, color and tone correction of images (including RAW formats: NEF, CR2, ARW, DNG, ORF, RW2, RAF);
— image resolution increase (upscaling);
— AI restoration of facial details in photographs;
— priority processing (turbo mode).
2.3. Supported file formats: RAW (NEF, CR2, ARW, DNG, ORF, RW2, RAF), JPEG, PNG, WebP, TIFF, HEIC/HEIF, AVIF, JXL. Maximum file size — 50 MB.
3.1. The internal currency of the service is the token. Rate: 1 token = 0.01 BYN. Service prices are indicated in tokens on the fotolab.by website and the @fotolabbybot Telegram bot.
3.2. Service rates:
— color correction — 20 tokens (0.20 BYN);
— upscale — 20 tokens (0.20 BYN);
— face restoration — 15 tokens (0.15 BYN);
— full package (color correction + upscale + face restoration) — 50 tokens (0.50 BYN);
— turbo mode — increases the cost by 20%.
3.3. When purchasing tokens, payment is made in Belarusian rubles (BYN). The payable amount is calculated at the official rate of the National Bank of the Republic of Belarus on the date of payment, increased by 3% (in accordance with Article 298 CC RB).
3.4. The Provider provides the Customer with an electronic receipt generated in the MNS "Tax on Professional Income" application by sending a link or file in the @fotolabbybot Telegram bot chat or to the Customer's email.
3.5. Upon registration, each Customer is credited with 250 free tokens. Free tokens expire and are refreshed every 30 calendar days provided the Customer is active. Free tokens are spent first.
4.1. The Customer uploads a photograph through the fotolab.by web interface or the @fotolabbybot Telegram bot. The Provider sends the image to the AI pipeline for processing.
4.2. The service is deemed fully rendered at the moment the processing result (file or download link) is provided to the Customer.
4.3. Tokens spent on processing are non-refundable. This condition is justified as follows:
a) Under Article 736 CC RB, refunds for properly rendered services after the start of actual performance are not provided.
b) Under Article 31 of the Law of RB "On Consumer Protection", the consumer may refuse a service only before it is actually provided. After processing is completed and the result is provided, the right of refusal lapses.
c) The technical nature of the service (instant allocation of GPU computing resources and generation of digital content) makes it impossible to return the service. Once processing starts, resources are already consumed and cannot be returned.
d) The Customer's subjective assessment of the aesthetic result is not grounds for a refund if the algorithm performed according to the specified parameters.
4.4. The Provider may, at its own discretion, credit tokens to the Customer as compensation in the event of a confirmed technical failure that resulted in the complete inability to obtain a processing result.
4.5. The Provider reserves the right to limit processing speed to ensure system stability: no more than 1 active task per user, no more than 1 photo per minute, 50 per hour, 500 per day for the entire system.
5.1. All Customer files are processed and stored exclusively on servers located in the Republic of Belarus. Transfer of files outside the Republic of Belarus in unencrypted form is not performed.
5.2. Original and processed files are stored for no more than 24 hours from the moment processing is completed, after which they are automatically deleted.
5.3. The Customer has the right to delete their files early at any time through their account on fotolab.by or using the "Delete my data" command in the @fotolabbybot Telegram bot.
5.4. Only the Customer has access to their files through authorized access. The Provider does not view or use uploaded images for purposes other than providing the ordered service.
6.1. By pressing "/start" in the @fotolabbybot Telegram bot or registering on fotolab.by, the Customer consents to the processing of personal data (Telegram ID, email, photo metadata) under the Law of the Republic of Belarus No. 99-Z "On Personal Data Protection".
6.2. The Provider undertakes to use uploaded images solely for the purpose of processing them. Uploaded images are transmitted over a secure channel (HTTPS/TLS).
6.3. The Customer may at any time request deletion of all their personal data and files by contacting their account, the @fotolabbybot Telegram bot, or by email info@fotolab.by.
7.1. The Customer guarantees that uploaded images do not violate the rights of third parties and the applicable legislation of the Republic of Belarus.
7.2. The Provider is not responsible for the artistic quality of processing results, as processing is performed automatically. The result depends on the initial quality and content of the photograph.
8.1. This offer takes effect from the moment of publication on fotolab.by and remains in force indefinitely.
8.2. The Provider may unilaterally change the terms of this offer with notification to the Customer through the website.
8.3. The legislation of the Republic of Belarus applies to this offer.
